Rose Mbithe, her children among five charged over Lawyer Mbobu’s murder

The Director of Public Prosecutions (DPP) has approved fresh murder charges against five suspects linked to the killing of prominent Nairobi lawyer Mathew Kyalo Mbobu, adding a new turn to a case that has already connected some of the suspects to another murder investigation.

The five suspects are politician Rose Mbithe Mulwa, her two children Chris Mulwa and Angela Mulwa, and police constables Julius Kipkoech Cheruiyot and Kennedy Kipkemei Borboroi.

In a statement issued on Thursday, October 8, the DPP said the five had been linked to the murder of Mbobu, who was shot dead in a drive-by shooting along Magadi Road on September 9, 2025.

“The Director of Public Prosecutions (DPP) has approved murder charges against five suspects accused of killing lawyer Mathew Kyalo Mbobu,” the prosecution said.

The latest charges come as three of the suspects are already facing separate murder charges in connection with the death of Dr Victoria Mutiso.

Dr Mutiso was shot on July 29, 2026, in Upper Hill, Nairobi, in a case that has also been under investigation by detectives.

The developments followed the arrest of a police constable on September 24. Investigators suspect the officer was involved as the gunman in the shooting that killed Mbobu.

After the DPP approved the charges, the two police officers were taken before the Kibera Law Courts. However, they did not take a plea to the murder charges.

The court subsequently directed that the officers undergo mental assessment at Mbagathi Hospital.

The assessment is expected to establish whether they are mentally fit to understand the charges and participate in court proceedings.

The five suspects are expected back in court on October 27. They are expected to take a plea after the court receives the mental assessment reports concerning the two police officers.

The investigation has also widened, with the Directorate of Criminal Investigations (DCI) pursuing a police inspector who has been linked to the alleged coordination of the operation.

Detectives are continuing to examine the circumstances surrounding Mbobu’s death as well as the separate case involving Dr Mutiso. Investigators are seeking to establish how the suspects may have been connected to the incidents, including the planning and execution of the attacks.

The approval of the new charges means the suspects will now face another stage of the legal process, with the court expected to formally deal with the murder case once the required assessments are completed.

Investigations into both deaths remain ongoing as detectives pursue additional leads and seek to establish the full circumstances behind the two killings.
