A petition has been filed with the Judicial Service Commission (JSC) seeking the removal of Justice Alfred Mabeya from office.
The petition, lodged by Cytonn CEO Edwin Dande, accuses the judge of serious misconduct, bias, and corruption.
Dande’s petition highlights 15 major grounds for the judge’s removal.
One of the most serious allegations is that Justice Mabeya has issued liquidation orders without any party requesting them.
He is also accused of making unfounded claims of fraud without following due process, resulting in unjust rulings that condemned parties not even involved in the cases.
These actions have been described as reckless and damaging, causing unnecessary suffering for many who are already struggling to navigate legal challenges.
Furthermore, Dande alleges that Justice Mabeya ignored stay orders issued by the Court of Appeal, allowing actions on cases under appeal to continue unlawfully.
This undermines the very essence of the justice system, where appeals should halt actions until they are properly reviewed.
In one case, Dande claims the judge delayed releasing case files after issuing a ruling, obstructing parties from filing timely appeals.
This deliberate action, according to Dande, was part of a larger pattern of behavior that suggests a deeper, more corrupt scheme involving individuals from the Official Receiver’s Office and the Company Registry, who are allegedly working together to dismantle businesses under the guise of following the Insolvency Act.
The petition also points to Justice Mabeya’s temperament and conduct in the courtroom.
Dande recounts several instances where the judge was dismissive and rude towards parties challenging his decisions.
In one case, he allegedly referred to applications challenging his orders as “bloody applications,” showing a lack of professionalism and respect for the legal process.
He is said to have made derogatory comments about higher courts, further undermining the integrity of the judiciary.
Dande has called for President William Ruto to immediately form a tribunal to investigate these serious allegations against Justice Mabeya.
The petition stresses that the judge’s behavior has not only harmed businesses but has also eroded public trust in the judicial system.
Dande emphasized the importance of restoring confidence in the judiciary, urging the JSC to take swift action to hold the judge accountable.
