Detectives from the Directorate of Criminal Investigations (DCI) Buruburu have arrested a 32-year-old man over remarks intended to incite ethnic hatred, hostility and violence against Burundian nationals living and working in Kenya.
The suspect, identified as Kevin Odiwuor Otieno, also known as Engineer Kevin, was arrested following remarks he made at Jacaranda Grounds in Kayole during a Bunge la Mwananchi event.
The remarks were captured on video and later circulated widely on social media, prompting detectives to launch investigations.
Preliminary investigations established that the remarks were directed at Burundian nationals residing in Kenya and involved in different economic activities, including employment.
Detectives are examining the circumstances surrounding the remarks and the intention behind them as part of investigations into offences related to hate speech and ethnic incitement.
The suspect is expected to face charges of hate speech contrary to Section 13(1)(a), as read with Section 62 of the National Cohesion and Integration Act.
Additional charges may also be brought depending on the outcome of the ongoing investigations. He is scheduled to be arraigned in court tomorrow.
The DCI has reminded members of the public that freedom of expression is protected by the Constitution, but it does not extend to hate speech, ethnic incitement or calls for violence.
Kenya is home to people from different ethnic communities and nationalities. Many foreign nationals also live and work in the country and take part in various economic activities.
The DCI warned that targeting individuals or communities because of their nationality or ethnicity, particularly where such conduct is intended to promote hatred, hostility or violence, will not be tolerated.
Members of the public have also been urged not to take the law into their own hands or engage in actions that could threaten peace and public order.
DCI detectives will continue monitoring public gatherings and online spaces for content and conduct that could threaten national cohesion, public safety and peaceful coexistence.
The DCI said those found culpable will be dealt with in accordance with the law, as investigations into the matter continue.
