According to a report from Citizen Digital, the Judicial Service Commission (JSC) has confirmed the receipt of five petitions filed against various judges of the Supreme Court and High Court, including Chief Justice Martha Koome.
These petitions, filed by advocate Nelson Havi, allege gross misconduct and misbehaviour by the judges.
The petition, received by the JSC on January 13, 2025, names Lady Justices Philomena Mwilu, Njoki Ndung’u, and Justices Mohammed Ibrahim, Dr. Smokin Wanjala, Isaac Lenaola, and William Ouko.
JSC Vice Chairperson Isaac Rutto stated that if the petition holds merit, the commission will recommend to the president to form a tribunal to remove the judges.
In addition, two separate petitions were lodged against High Court Justice Alfred Mabeya, alleging gross misconduct.
One petition was filed by Havi on January 10, 2025, and received by the JSC on January 13, while the other was filed by Edwin Dande, the CEO of Cytonn Kenya, on December 16, 2024, and received on December 18, 2024.
Furthermore, a petition was filed against High Court Justice Lucas Leperes Naikuni on January 10, 2025, also by Havi, accusing him of incompetence in his judicial duties.
The JSC confirmed that it would handle all petitions according to established procedures, in line with the constitution, the Judicial Service Act, and international best practices.
As reported by MOE on X, the JSC has dealt with 935 petitions against judges between 2011 and 2024. Of these, 862 petitions were finalized, and 12 were forwarded to the president with a recommendation to form a tribunal for removal.
The remaining 73 petitions are still under processing.
