Businessman Mandeep Singh Channa has been charged in over documents used in the resignation of a director and the transfer of shares in Channa Investments Limited.
Channa appeared before the court, where he denied the charges relating to the preparation and submission of documents that the prosecution claims were forged. He pleaded not guilty and was released on a cash bail of KSh300,000 as the case proceeds through the legal process.
According to the charge sheet, Channa faces several counts under the Penal Code, including making and uttering false documents.
The charges involve an affidavit, company board meeting minutes, a resignation letter and documents connected to the transfer of 4,000 ordinary shares.In the first set of charges, the prosecution accuses Channa of making an affidavit dated October 19, 2022, which purported to be a genuine document sworn by Supinderpaul Singh before Esther Asati, an advocate and Commissioner for Oaths.
The prosecution claims that the affidavit was made knowing that its contents were false.
Channa is also accused of uttering the same affidavit on October 25, 2022. According to the charge sheet, he submitted the document through his eCitizen account on the Business Registration Service (BRS) system.
The document was reportedly used to support the resignation of Supinderpaul Singh as a director of Channa Investments Limited.
The businessman faces additional charges involving minutes of a board meeting dated October 19, 2022.
The prosecution claims that the minutes were made to appear as genuine records of a properly convened company meeting.
Channa is accused of later submitting the minutes through the BRS system on October 25, 2022, for the same purpose of supporting the director’s resignation.
Another count concerns a resignation letter dated October 19, 2022. The prosecution alleges that the letter was prepared to appear as though it had been properly executed and signed by Supinderpaul Singh.
Channa is accused of submitting the document through his eCitizen account on the BRS system while knowing that it was false.
The case also includes accusations relating to the transfer of 4,000 ordinary shares in Channa Investments Limited.
According to the charge sheet, the shares were transferred from Supinderpaul Singh to Mandeep Singh Channa.
The prosecution claims that Channa made a share transfer document dated July 3, 2023, presenting it as a genuine document authorising the transfer of the shares.
He is further accused of uttering the document on July 25, 2023, by submitting it through his eCitizen account on the BRS platform.
Channa also faces a charge involving an affidavit dated July 25, 2023. The prosecution alleges that the document was made to appear as though it had been sworn by Supinderpaul Singh before Esther Asati. The affidavit was reportedly submitted through the BRS system to support the transfer of the 4,000 shares.
The businessman has denied all the charges brought against him and maintained his plea of not guilty during his court appearance. The accusations remain matters for determination through the court process, and the prosecution will be required to present evidence in support of its case.
Following his plea, the court granted Channa a cash bail of KSh300,000.
