Businessman Brian Kipruto Koech charged over alleged Sh11.4 million fraud and money laundering

Businessman Brian Kipruto Koech has been charged at the Milimani Law Courts over allegations of obtaining Sh11.4 million through false pretences and acquiring and using proceeds of crime.Koech appeared before the court on Tuesday, October 27, where he denied three charges brought against him by the Director of Public Prosecutions (DPP).

The court granted him cash bail of Sh3 million, with two sureties of a similar amount as he awaits the hearing of the case.

According to the prosecution, Koech allegedly committed the offences between January 29 and March 17, 2026, in Nairobi County, acting jointly with other individuals who have not been brought before the court.

The first charge relates to obtaining money by false pretences, contrary to Section 313 of the Penal Code.Court documents indicate that Koech allegedly obtained Sh11,408,000 from businessman Abdalla Faraj Abdalla in Nairobi’s Central Business District during the stated period.

The prosecution claims that Koech convinced Abdalla that he was in a position to purchase cereals, sell them on his behalf and return the profits generated from the transactions.

However, the charge sheet alleges that Koech made the representation knowing it was false.

The second charge concerns the alleged acquisition of proceeds of crime under Section 4(a), read together with Section 16(1)(a) of the Proceeds of Crime and Anti-Money Laundering Act, No. 9 of 2009.

According to the prosecution, Koech received the Sh11,408,000 from Abdalla through his Absa Bank account on various dates between January 29 and March 17, 2026.

The prosecution alleges that Koech knew or ought reasonably to have known that the money deposited into his account constituted proceeds of crime.

He also faces a separate charge of using proceeds of crime, contrary to Section 4(b), read together with Section 16(1)(a) of the same law.

The particulars of this charge state that Koech allegedly used the Sh11,408,000 held in his Absa Bank account on various dates between January 17 and March 17, 2026, in Nairobi County.

Prosecutors further allege that he knew or ought reasonably to have known that the funds were proceeds of crime or formed part of money obtained through criminal activity.

The three charges relate to the same amount of money, with the prosecution seeking to establish how the funds were obtained, received and subsequently used.

Koech denied all the charges when he appeared before the court. The allegations remain unproven, and the case will proceed through the court process.
